Zone & Company Software Consulting, LLC,Zone and Company Software Consulting EMEA B.V., Zone & Company APAC Pty Ltd. (collectively, “Zone”) and its affiliates and subsidiaries are committed to protecting your privacy and providing you with a secure experience through use of Zone’s software and services (“Products”) and websites (“Sites”). In delivering its Products, Zone collects information to provide services and/or information that you request. This statement of privacy (the “Privacy Policy”) explains Zone’s data collection and use practices. This Privacy Policy applies to your use of Zone’s Products and Sites. Please read this Privacy Policy carefully.

 References in this Privacy Policy to “we,”“us” or “our” are references to Zone. Statements referring to “you” or “your”are references to the company or individual we are collecting personal information about.

ACCEPTANCE

By accessing and using any Product or Site, you accept and agree to this Privacy Policy. If you do not agree to this Privacy Policy, please do not use any Product or Site. WHAT TYPE OF INFORMATION WE COLLECT

"Personal information" is any information that can be used to identify an individual, and may include name, username, mailing address, email address, phone number, voicemail identifiers, location identifiers, occupation, login information (username, account number, password, profile picture), language and marketing preferences, social media account information, or payment card number. Other information we collect may include information from our vendors, suppliers, service providers, agents, consultants, business partners, professional advisors and other third parties for the purposes of managing and operating our business. For example, we may collect business contact information, financial information, and other information necessary to engage third parties and to evaluate their performance.

We may also collect certain in formation automatically when you use the Products, including, but not limited to, usage information (such as user activity, configuration, and performance metrics data) and log information (such as IP addresses, ISP, browser type, clickstream data, security information, errors and crashes).

We collect data in a variety of ways, including by use of:

·       Order forms, Quotes and/or other transactional documents
·       Account Registrations

 Cookies are small text files placed on your device to store data that can be recalled in compliance with this Privacy Policy. This data uniquely identifies your device but may also contain other information. Some cookies are placed by third parties acting on our behalf which we describe below under “Third-party cookies”. Our cookies help provide additional functionality to and track traffic patterns on the Sites, combat potential fraud, and study how our users use and interact with the Products and Sites. In addition, we may use cookies to personalize service to you such as providing suggestions, or personalized or customized content. Cookies also help us keep track of your preferences.

 Strictly Necessary cookies: These cookies are necessary for the Products or Sites to function and cannot be switched off in our systems. They are often set in response to actions taken by you, such as a request for services, setting your privacy preferences, logging in or filling in forms.

Functional cookies: These cookies enable the Products or Sites to provide enhanced functionality and personalization.

 Performance cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Sites. They help us to know which pages are the most and least popular and see how visitors move around the Sites.

 Targeting cookies: These cookies may be set through our Sites and may be used to build a profile of your interests and show you relevant adverts on other sites.

 Third-party cookies: In addition to our own cookies, we may also use various third-party cookies to report usage statistics of the Products or deliver marketing and other communications.

In general, you do not need to have cookies turned on to visit our Sites. You can refuse cookies by setting your website browser to decline cookies automatically or to give you the choice of declining or accepting the placement of cookies from the Sites. That said, some of our Sites may require you to accept a mandatory session cookie, which you can delete after you leave the Sites.

We also may collect information related to your company, approximate geographic location, or other demographic information that does not personally identify you.

To the extent permitted by applicable law, we reserve the right to combine other information as defined above with PersonalInformation that you submit.

WHY WE COLLECT THE INFORMATION

Zone collects information for a variety of business and lawful purposes, including, but not limited to:
·      to create your account and process your purchase of our Products, including payment transactions (including payment and personally identifiable information verification
·      to provision, facilitate and ease your use of the Products and Sites
·      to send Products updates and upgrades, marketing and other communications
·      to deliver, enable and support the use and/or testing of certain features of our Products
·      to personalize your experience
·      to comply with legal requirements and to prevent activities that may violate our policies
·      to provide customer support
·      for prevention and detection of fraud and other unauthorized use
·      where we have the appropriate permissions, to inform you of new Products that will enhance Zone’s ability to provide service to you; however, we will not sell, rent, trade, lease, or disclose or make available any personal data to any third parties seeking to market products to you without your prior consent
·      to manage a job application; and/or, perform market research or to conduct surveys unless you have requested that we not contact you for this purpose.

DATA TRANSFERS TO THIRD PARTIES

Zone will not disclose or share your Personal Information outside of Zone except in limited circumstances, such as:
·      in order to support the uses mentioned above
·      for processing orders and credit card transactions, delivering Products, hosting the Sites, providing customer support, and engaging in marketing activities
·      in response to a request for information by a competent authority if Zone believes disclosure is in accordance with, or is otherwise required by any applicable law, regulation or legal process
·      to protect the rights, property, or safety of Zone, its business partners, you, or others
·      in connection with, or during negotiations of, any merger, reorganization, restructuring, consolidation, acquisition, financing, dissolution or sale of all or a portion of the business or financing, dissolution, or acquisition of all or a portion of Zone’s business by or to another company
·      if we otherwise notify you and you consent to the sharing.

When you provide personal information to us, we will not share that information with unaffiliated third parties without your permission, other than in circumstances described above. We may send out important notices informing you of changes to our policies, technical service issues related to our Products, or other information that is essential to the use of our Products or Sites. You or we may post feedback, or community postings, blog or other information on our Sites which may include your name, industry, company, title, or other identifying information. Any postings that you make, or that we make with your consent, are made at your own risk, and we will not be liable for the posting or the distribution of the information contained or associated with the posting. If you want such postings removed or wish to give or withdraw consent, please contact us at privacy@zoneandco.com. We cannot guarantee the requested removal, but will make reasonable efforts to do so.

You may encounter links to third-party sites (e.g., business partners) and although a connection may be made to such sites, we are not responsible for their privacy policies and this Privacy Policy does not cover their practices.

HOW WE PROTECT YOUR INFORMATION

Zone protects the Personal Information entrusted to us and treats it securely in accordance with this Privacy Policy. Zone implements safeguards designed to protect your Personal Information from unauthorized access, use, or disclosure. We also contractually require that our suppliers protect such information from unauthorized access, use, and disclosure. We make good faith efforts to provide the security measures necessary to keep the integrity and confidentiality of your information safe. Not withstanding the foregoing, no system can be completely secure, and we do not ensure, guarantee or warrant that our security measures are impenetrable. The Internet, for example, cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any Personal Information you provide to us. Also, please be advised that Zone has no control over or responsibility for the security or privacy policies or practices of other sites on the Internet you might visit, with which you interact, or from which you might buy products or services, even if you visit them using links from the Sites.

You also have a significant role in protecting your information. As an example, you should not share your ZoneProduct passwords, if applicable, with anyone. If you believe that your password has been compromised, you should immediately change your password. You should also sign off when you’ve finished using a shared computer, and you should always log out of any website, including the Zone Sites when not actively in use.

YOUR CHOICES

You may unsubscribe from our marketing communications by following the instructions or unsubscribe mechanism in the e-mail message. To opt out of receiving marketing related communications from us, please click on the “opt-out” link in the communication or please contact us at privacy@zoneandco.com or by contacting us as described in the “How to Contact Us” section below. Please note that if you do opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, and you cannot opt-out from receiving account-related or other administrative messages.

TRANSFER OF YOUR INFORMATION ACROSS BORDERS

Your information may be stored and processed in the United States or any other country in which Zone or its partners maintain facilities. By using our Products and Sites, you consent to any transfer, storage, or processing of information outside of your country. You may request us not to transfer your personal information to the certain countries, but if you do, we may not be able to provide the Products you have requested from us. Several countries, including those in the European Economic Area (EEA), the United Kingdom (UK) and Switzerland have established data protection laws and regulations that place restrictions on the transfer of personal information across country borders. We are committed to complying with all those laws and regulations.  

Some countries may not have the same or substantially similar privacy laws as those set out in this Privacy Policy. We may not require organizations to which we disclose personal information in those countries to comply with similar privacy laws, and accordingly your personal information may not receive the same protections that it would under the laws where you are located. Where personal information in the EEA, the UK or Switzerland is being transferred to a recipient located in a country that has not been recognized by the relevant authorities as having an adequate level of data protection, Zone will transfer Personal Information in accordance with the Standard Contractual Clauses approved by the relevant authorities. 

When you use our Products and Sites and provide Personal Information, you should do so in compliance with the applicable data protection laws and regulations in your country.

YOUR PRIVACY RIGHTS AS A DATA SUBJECT PROTECTED BY EEA/UKLAW OR AS A CALIFORNIA RESIDENT

If you are a person located in the EEA/UK or if you are a California resident, you may have broader rights to access and delete your Personal Information, to object to or restrict processing of your Personal Information, to correct your personal information, or request portability of your Personal Information.

·       Access: You can request more information about the Personal Information we hold about you.You can request a copy of the Personal Information.

·       Rectification: If you believe that any Personal Information, we are holding about you, is incorrect or incomplete, you can request that we correct or supplement the data. You can also correct some of this Personal Information directly by logging into your account, if you are a customer. Please contact us as soon as possible if you notice any inaccuracy or incompleteness.

·       Objection: You can let us know that you object to the collection or use of your personal data for certain purposes.

·       Erasure: You can request that we erase some or all of your Personal Information from our systems.

·       Restriction of Processing: You can ask us to restrict further processing of your Personal Information. This means that you can ask us to stop using it for the purpose we have been using it. This may mean that we have to delete your account.

·       Portability: You can ask for a copy of your Personal Information in a machine-readable format.You can also request that we transmit the data to someone else where it’s technically possible.

·       Withdrawal of Consent: If you have consented to our use of Personal Information for a specific purpose, you have the right to change your mind at any time. Any such decision will not affect any processing that has already occurred, nor will it affect processing of your Personal Information conducted in reliance of lawful processing grounds other than consent. Withdrawing your consent may mean your access to the Products or Sites will be limited or suspended, and your accounts may be terminated, as applicable. Where you withdraw your consent, but we are using your Personal Information because we or a third party (e.g., your employer) have a legitimate interest in doing so, or we have different legal basis for using your Personal Information (for example, fulfilling a contract with you), we may continue to process your Personal Information, subject to your rights to access and control your information.

·       Right to File Complaint: You have the right to lodge a complaint about our practices with respect to your personal data with the supervisory authority of an EU Member State, or the California Attorney General.

Additional Privacy Rights as a California Resident

If you are a California resident and access Products or visit our Sites solely asa private individual—in other words, not as the member or representative of a company or other organization—you may have the right to receive a free, yearly accounting of:
·       information identifying each third-party company to whom we may have disclosed, within thepast year, Personal Information pertaining to you for those third parties’ direct marketing purposes and
·       a description of the categories of Personal Information disclosed.

You may have the right to know more about Personal Information that we have collected or disclosed, including:
·       the categories of personal information that we have collected or shared about you during the preceding 12 months
·       the categories of sources from which we have collected that information during the preceding 12 months
·       the commercial or business reason(s) we have collected or shared that information
·       the categories of third parties with whom we have shared or to whom we have sold that information during the preceding 12 months
·       pursuant to a verifiable request, the specific pieces of information that we have collected about you.

We will not discriminate against you for exercising any of these rights under the CCPA.

Depending on the nature of your request, we may need additional information to verify your identity.

RETENTION PERIOD

We will retain your personal information for no longer than is necessary to fulfill the purposes for which the information was originally collected. However, if a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes, we will retain the information in accordance with such requirements or purposes.

Where we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

Amendments

Zone reserves the right to change, modify, add or remove portions of this Privacy Policy at any time. When we do so, we will revise the date at the top of the first page of the Privacy Policy. When you visit our Sites, you are accepting the then-current version of this Privacy Policy. We recommend that users revisit this Privacy Policy on occasion to learn of any changes.
